Abstract
Osnovna zadaća ovog rada je prikazati kako se koriste porezne oaze za izbjegavanje plaćanja poreza i na koji način se međunarodna zajednica bori protiv toga. Detaljno su analizirani porezi u Republici Hrvatskoj i porezne utaje koje se događaju i na koji način. U nastavku obrađene su porezne oaze kroz njihov povijesni pregled i prikazana njihova glavna obilježja. U nastavku su prikazane detaljno po vrsti poslovanja koji se u njima obavlja. U radu se analizira njihov utjecaj na svjetsko poslovanje. Za bolje razumijevanje teme napravljen je presjek prednosti i nedostataka poslovanja u poreznim oazama na primjeru postojećih poreznih oaza. U nastavku su prikazane i najpoznatije svjetske afere vezane uz poslovanje u poreznim oazama i njihov učinak na svjetskoj razini. Pregledom ugovora o izbjegavanju dvostrukog oporezivanja i izbjegavanju plaćanja poreza definiralo se što je to porezna evazija, a što je izbjegavanje plaćanja poreza. Pregledom akcijskog plana Europske komisije i Akcijskog plana OECD-a prikazani su pokušaji međunarodne zajednice u borbi sa izbjegavanjem plaćanja poreza na globalnoj razini i ujednačavanjem velikog broja poreznih pravila.
Abstract (english)
The main purpose of this paper is to show how tax havens are used to avoid paying taxes and how the international community is fighting against it. Tax evasion that occurs in Croatia is showed and analyzed. In the following, tax heavens are showed with historic breakdown and their main characteristics. Tax heavens are showed and analyzed by the type of work that is conducted in them. This paper also analyzes their impact on world business. To better understand the topic, a cross-section of the advantages and disadvantages of doing business in tax havens was made on the example of existing tax havens. The most famous world scandals related to business in tax havens and their impact on the world level are also presented below. The review of double taxation and tax avoidance agreements defined what tax evasion and tax avoiding. The review of the European Commission's Action Plan and the OECD Action Plan shows the international community's efforts to combat global tax evasion and to harmonize a large number of tax rules.
